Ex-Eastleigh Police Boss, Officer Charged With Torturing UK Citizen

Two former police officers are facing serious charges after allegedly torturing and intimidating a UK national who had reported an assault case. The accused, former Eastleigh North Police Station Commander Rebecca Muraya and her junior officer Abdisalam Ahmed, appeared before Milimani Chief Magistrate Lucas Onyina where they denied all charges.

According to court documents, the charges stem from a December 31, 2021, incident in which Muraya and Abdisalam reportedly ordered the unlawful arrest and detention of Ayni Hussein Mahammud, a British citizen. Ayni had filed an assault complaint against Abdihakim Saidi Jama. Instead of arresting Jama, the officers allegedly detained Ayni at Muthaiga Police Station for two days.

Prosecutors say the detention was carried out with the intention of intimidating Ayni from pursuing the assault complaint against Jama. Both officers are now facing charges of torture and abuse of office under Kenyan law. The abuse of office charge falls under Section 10(1) as read with Section 102 of the Penal Code.

Although the officers had initially appeared in court last year, they were out on a bond of Sh500,000 each. Magistrate Onyina ruled that they would remain free on the same bond terms as the case continues. The next court mention is scheduled for April 25.

The original case that led to the charges involved Abdihakim Saidi Jama, who was later prosecuted after the Directorate of Criminal Investigations (DCI) took over the matter. Jama was found guilty at the Makadara Law Courts and fined Sh100,000 for assaulting Ayni.

Ayni recently wrote to the court on April 15, raising concerns over delays in the prosecution of the two officers. Her letter prompted renewed attention to the matter, leading to the current charges.

The case highlights ongoing concerns about abuse of power within law enforcement and the need for accountability when officers are accused of misconduct, especially involving foreign nationals.
