A real estate company boss is facing legal action after allegedly scamming a customer out of Ksh.6.4 million for a house in Syokimau. The complainant, who filed the case in court, claims to have made the payment seven months ago, but no construction work has begun on the property.
The individual, whose identity remains protected, reported that they paid the full Ksh.6.4 million as a deposit for a house that was promised to be built in Syokimau, a fast-growing area just outside Nairobi. Despite the large sum paid, there has been no progress on the construction site, and the house has not been delivered as promised.
According to the complainant, the deposit was made in good faith, under the belief that the construction would begin promptly. However, after waiting for months with no action taken, they approached the real estate company to seek answers. The company, led by the accused, allegedly failed to provide any clear explanation or assurances regarding the status of the project.
The case has now moved to court, with the real estate boss, identified as Maalim, facing charges related to fraudulent dealings and failure to deliver on a contractual agreement. The complainant claims that the funds were handed over based on the company's assurances that the house would be ready within a specified time frame. However, that deadline passed without any construction being initiated, leading to the legal action.
The court case highlights the growing concerns over fraudulent activities within the real estate sector, especially in areas like Syokimau, where demand for housing is high. Many buyers in these rapidly developing areas are now more cautious and seeking legal protections when dealing with property developers. As the case continues, both the complainant and the real estate boss will likely present their sides in court, with a ruling expected in the coming months.
The outcome of this case could set a precedent for how similar real estate disputes are handled in Kenya, especially as property fraud remains a significant issue in the country.
